Enkla i Malmö AB is the data controller as stated above.
Enkla i Malmö AB complies with Swedish data protection legislation.
Contact support@Hejdi.se for further information and contact regarding our data protection policy.
“Hejdi” is Enkla i Malmö AB, which operates the website hejdi.se/.com/dk (the “Website”), where all services (the “Services”) are provided. The Services include, among other things, an integrated design tool (the “Design Tool”), which allows the user (“you” or the “User”) to create and order customized products. By registering a personal account (“Account”), the User gains access to additional features and benefits within the Services.
Use of website & services
The Website and the Design Tool, including the underlying software, code and all functionality provided through the Services, constitute the exclusive property of Hejdi or its licensors. The User acquires only a limited right to use the Design Tool in accordance with these Terms and may not reproduce, distribute or otherwise exploit the Design Tool in a manner that goes beyond what is expressly permitted herein. Any attempt to decompile, reverse engineer or otherwise circumvent the protection mechanisms of the Design Tool is prohibited and may result in both contractual and criminal penalties.
If the Service is used by persons resident or domiciled in a country other than Sweden, it is the responsibility of such users to ensure compliance with local laws and regulations. However, Hejdi is governed by Swedish law, and any disputes arising from the use of the Service shall be settled primarily in accordance with Swedish law and, where applicable, before a Swedish court. Each international user thereby undertakes to accept Swedish jurisdiction for matters relating to the service.
– Use of design elements in the design tool
The design elements, templates and other graphic components included in the design tool are the property of Hejdi and are protected by intellectual property law. The user is allowed to use these design elements only for the purpose of producing personalized products within the framework of this service. If a user intends to resell products that include such design elements, these elements shall not constitute the main or central motif of the final design. Any other form of reproduction, modification or commercialization of the design elements is prohibited without prior written consent. Any violation of this provision may lead us to take legal action to protect our intellectual property rights.
– Uploading content
The user is responsible for ensuring that any content (images, texts or other material) uploaded to the system does not infringe the rights of third parties or contravene current legislation. Material that is pornographic, inflammatory, offensive or otherwise illegal or inappropriate is prohibited. Should uploaded content give rise to claims from third parties, the user undertakes to fully bear any costs and compensation claims arising from this. Hejdi reserves the right, without prior notice, to refuse production or to cancel an ongoing order if the material is deemed to violate these terms and conditions or the law. In the event of such cancellation, no compensation or refund will be paid to the user, regardless of whether production has partially commenced or not.
Hejdi does not undertake any obligation to actively monitor or pre-screen all material uploaded by users. The user bears sole responsibility for whether uploaded content may constitute an infringement of third party rights or otherwise violate applicable law. If Hejdi becomes aware of an infringement, we reserve the right to act immediately in accordance with our terms and conditions and available legal options. By using the service, the user thus accepts that no general control responsibility is incumbent on Hejdi.
— Infringement of third party intellectual property rights
A pattern of repeated uploads that infringe the intellectual property rights of third parties or otherwise violate the law or applicable terms and conditions may result in the permanent suspension of the user’s account. In particularly serious cases, information about the infringement may be passed on to the relevant rights holders or authorities. Anyone uploading protected material without authorization bears full responsibility for any claims and costs incurred, and the service provider reserves the right to take further legal action if necessary.
– Deadlines and removal of files
Uploaded files and projects are stored in the system only for as long as it is necessary to provide the service and to enable subsequent handling, such as complaints or customer service cases. Hejdi reserves the right to delete files and projects that remain inactive for an extended period of time without prior notice to the user. If a user wishes to keep files or projects for a longer period of time, it is the user’s responsibility to ensure the necessary local copies.
If no customer account is registered and a project/design is saved in the design tool, the project may be deleted from the system after a 120-hour time limit. A user who wishes to keep or continue developing a particular project for a longer period of time is encouraged to create an account to avoid the project being automatically deleted. Hejdi can delete projects that remain inactive for a longer period of time.
– Right to change and adapt
Sometimes technical or production adjustments are required to make an uploaded file work well in the process. These adjustments may include, for example, changes to the file format, resolution or color profile. Hejdi always strives to preserve the overall design of the file and the quality of the subject. If a planned change is deemed to be so extensive that it noticeably affects the appearance of the motif, contact is made with the customer for approval as far as possible. If the customer does not respond within a reasonable time, the order may be carried out in the modified form or canceled completely.
— Restrictions on changes after confirmed order
Once the customer has placed an order and production has started, the possibilities to change the design are severely limited. Changes requested after confirmation may incur additional costs, and in some cases no corrections can be made at all depending on the production status. Customers are therefore requested to carefully review the design before the order is finally confirmed.
– Limitation of liability for technical faults
Circumstances such as server crashes, software failures, maintenance interruptions or other unforeseen technical events may cause the user’s project to be damaged or lost. In such a situation, Hejdi is not liable for indirect or consequential losses, such as loss of income or loss of profit. Any compensation for inconvenience caused is considered as a pure goodwill gesture and does not imply any formal acceptance of liability. The user is advised to regularly save local copies of important files and projects, as Hejdi cannot guarantee complete error-free or uninterrupted access.
Colors, prints and final results
The customer’s screen and the actual print can give different visual impressions of the same design. Computer screens, mobile phones and tablets reproduce colors based on varying brightness, contrast and color profile settings, while prints on textiles and other materials are affected by, for example, the texture, absorbency and printing method of the fabric. Even small differences in placement, sharpness or print distribution can occur as a result of natural variations in production. Since Hejdi strives for industry standards and works with calibrated equipment, we try to minimize such differences, but minor deviations are still considered normal and should not be considered a defect in the product. Users who desire exact color matches or have specific quality requirements should therefore note that some aesthetic differences may occur and that we do not guarantee complete conformity with the preview seen on the screen.
For example, when a customer designs a t-shirt in the design tool, a generic size (usually Medium) is displayed, which means that the print will be relatively larger on a t-shirt in size XS compared to a t-shirt in size 3XL. For completely natural reasons; there is simply more physical space on a large t-shirt compared to a smaller one.
Account
A user account is registered personally and may only be used by the person who created it. The user undertakes to protect their login details against unauthorized access and to inform Hejdi immediately in the event of any suspicion that third parties have gained access to the account. All activity that takes place via the account is assumed to have been carried out by the account holder. In the event of violations of these terms and conditions or if it is otherwise required for security reasons, Hejdi may suspend or terminate the account without the user being entitled to compensation or compensation
– Termination of account
An account can be closed in the user interface under Account or by contacting customer support. After termination, all files and ongoing projects are deleted without the possibility of recovery. By initiating such termination, the user confirms that none of the saved material will be reproduced or transferred to another platform. Hejdi is under no obligation to compensate for losses, missing projects or other damage that the user can refer to in connection with the termination of the account.
Misuse of services and account
If the user in any way misuses the website, the design tool, the design elements or the possibility to upload content, Hejdi is entitled to immediately take the necessary measures. Such action may include warning, removal of content, suspension of the user’s account or legal action when required. In cases of particularly serious or repeated violations, the suspension may apply indefinitely without the user being entitled to compensation or restoration of lost files and projects. In the event of serious or repeated misuse of the service or account, Hejdi may, in addition to suspending or terminating the account, decide to cancel all unexecuted orders and deny the user the possibility of creating new accounts under another identity. These measures are aimed at preventing further abuse and ensuring a safe and secure environment for other users.
Changes to the general conditions
Hejdi reserves the right to adjust or update these terms at any time. The latest version is always published on our website, and it is the responsibility of each user to keep up to date with any changes. By continuing to use the service after an update, the user is deemed to have accepted the revised version of the terms and conditions.
